Divorce mediation is an alternative to deciding your divorce case in front of a judge, where you will not have any power in the proceedings. Mediation is a suggested form of negotiation for any couple getting divorced in Texas. You will be required to attend mediation prior to facing a judge in family law court. Here’s a little explanation of the role of the divorce lawyer in divorce mediation.

When you go to divorce mediation, it’s best to bring your divorce attorney along with you. He or she will be able to answer all of your questions and guide you in the right direction. A divorce attorney representing you will help ensure that the decisions being made are in your best interest and are not taking advantage of you.

You should not go to these meetings alone simply because there is a mediator present. The mediator cannot make decisions for you, only move you and your spouse forward with guidance regarding listening and avoiding arguments. The mediator cannot give either party legal advice, even if he or she is a lawyer.

You should also have your divorce attorney review the agreement created between you and your spouse before you sign it. The lawyer will be able to find any inconsistencies and other issues that should or should not have been included in the agreement.

When going to mediation, your divorce attorney will be able to speak with the attorney for your spouse, handle questions and argue on your behalf should any other issues arise.
